Virginia Legal Notices & Service Terms
1. Licensing Disclosure (Virginia)
Nest Home Services performs plumbing work in accordance with the regulations of the Commonwealth of Virginia and the Virginia Department of Professional and Occupational Regulation (DPOR). All work is performed by or under the supervision of a properly licensed individual as required by Virginia law.
2. Estimates and Pricing
All prices listed on this form are estimates unless otherwise stated as a flat-rate service. Actual pricing may vary if concealed conditions, code-required upgrades, or unforeseen circumstances are discovered during the course of work. Any additional work requiring added cost will be communicated and approved prior to proceeding.
3. Authorization to Perform Work
By signing this form or clicking the review and approve to electronically sign, the customer authorizes Nest Home Services to perform the work described. Authorization may be provided via signature, electronic approval, text message, or email confirmation, which shall be considered legally binding.
4. Payment Terms
Payment is due upon completion of work unless otherwise agreed in writing. Failure to remit payment may result in additional fees, service charges, or collection activity as permitted under Virginia law.
5. Access & Work Conditions
Customer agrees to provide safe and reasonable access to the work area, including utilities and clearance. Nest Home Services is not responsible for delays or damage caused by pre-existing conditions, concealed defects, or code violations not visible prior to work.
6. Warranty Disclaimer
Labor warranties, if applicable, are limited to workmanship only and do not cover manufacturer defects, misuse, abuse, neglect, normal wear and tear, or damage caused by freezing, corrosion, or improper operation. Manufacturer warranties apply separately to fixtures, appliances, or equipment installed.
Worry-Free Guarantee:
Nest Home Services guarantees its installation workmanship for 2 years (Best Value) or 3 years (Premium Grade)from the date of completion. Should installation-related defects occur during the applicable period, Nest Home Services will return and correct the issue at no charge for labor. Manufacturer warranties apply separately to the water heater unit itself and are governed by the manufacturer’s terms and duration.
7. Limitation of Liability
To the fullest extent permitted by Virginia law, Nest Home Services shall not be liable for incidental, indirect, or consequential damages arising from the performance or failure to perform services.
8. Right to Cancel (Virginia Home Solicitation Sales Act)
If this agreement is signed at a location other than the seller’s place of business, the customer may have the right to cancel the transaction within three (3) business days, as provided under the Virginia Home Solicitation Sales Act (§ 59.1-21.1 et seq.). Written notice of cancellation must be delivered or mailed within the cancellation period.
9. Governing Law
This agreement shall be governed by and interpreted in accordance with the laws of the Commonwealth of Virginia.
Additional Terms, Notices & Customer Acknowledgments
Virginia Contractor License
Nest Home Services is licensed and regulated by the Virginia Department of Professional and Occupational Regulation (DPOR). License information is available upon request and may be displayed on invoices, estimates, or service vehicles as required by law.
Payment Methods Accepted
Accepted forms of payment include cash, digital check, ACH, and major credit or debit cards. Returned checks or failed payments may be subject to additional fees as permitted by Virginia law.
Late Payment & Collection Policy
Invoices are due upon completion unless otherwise stated in writing. Past-due balances may be subject to late fees, interest, or collection costs to the extent allowed by Virginia law. Customer agrees to be responsible for reasonable collection and attorney fees incurred to recover unpaid balances.
Service Call / Diagnostic Fee
A service or diagnostic fee may apply for evaluation, troubleshooting, or dispatch of a technician. This fee is non-refundable and may be applied toward approved repairs where applicable.
Change Orders & Additional Work
Any work not specifically listed in this agreement requires customer approval prior to proceeding. Approval may be provided verbally, in writing, electronically, or by text message and shall be binding.
Water Heater & Equipment Disclaimer
Installation of water heaters or equipment may require code upgrades, electrical or venting modifications, thermal expansion control, or replacement of existing components to meet current safety requirements. Such items may not be visible prior to beginning work and may result in additional charges.
Damage & Pre‑Existing Conditions
Nest Home Services is not responsible for damage resulting from pre-existing conditions including, but not limited to, corroded piping, aged fittings, improper prior installations, structural limitations, or concealed defects.
Customer Responsibilities
Customer agrees to provide safe access to the work area, remove personal items as needed, secure pets, and ensure utilities are available. Delays or inability to perform work due to access issues may result in additional charges. Nest Home Services may photograph or record video of the work performed before, during, or after service for documentation, training, quality control, and marketing purposes. Images or recordings may include the work area, equipment, or completed installation, but will not intentionally include personal identifying information.
Media & Marketing (opt out)
By signing this agreement, the customer grants permission by defaultfor such photos or videos to be used in print, digital, or online marketing materials, including websites and social media.
If the customer does not wish to grant this permission, they must opt out in writing prior to the start of work.
Photos or videos may be used for documentation and marketing unless customer opts out in writing prior to service. This opt-out applies only to future use and does not affect internal documentation or records required for business or legal purposes.
Warranty Statement
Labor warranties, if offered, apply only to workmanship and do not cover materials or manufacturer defects. Manufacturer warranties apply separately and are governed by the manufacturer’s terms.
Governing Law
This agreement shall be governed by and interpreted under the laws of the Commonwealth of Virginia.
Customer Acknowledgment
By digital acceptance or signature, the customer acknowledges that they have read, understand, and agree to all terms and conditions stated within this document, including pricing, payment terms, and legal notices.
